In the following Terms & Conditions, “Photographer” refers to Darius Bashar trading as Darius Bashar Photography. “Client” or “Student” refers to any person booking a shoot, workshop, or coaching session. These Terms & Conditions are binding and may not be altered unless explicitly agreed upon in writing by the Photographer.
1. Payment
Full payment is required at the time of booking to reserve your session. This payment secures your scheduled time and the services of the Photographer, and is non-refundable and non-transferable in the event of cancellation.
2. Rescheduling & Cancellation
If you need to reschedule, you must provide at least 3 weeks’ notice. If less notice is given, the original studio rental fee will be forfeited, and the Client will be responsible for any additional fees required to secure a new studio booking.
3. Late Arrivals & No-Shows
Clients and Students are expected to arrive on time for their shoot, workshop, or coaching session. If you arrive more than 15 minutes late, your session may be forfeited to respect the time of other clients. No refunds will be issued for missed or shortened sessions due to lateness.
4. Copyright & Reproduction Rights
All original photographic materials—including digital files, negatives, proofs, and previews—are the exclusive property of the Photographer. Photographer retains full copyright to all images created and holds the exclusive right to reproduce them unless otherwise agreed in writing. During group workshops, students may take photos of one another for practice. These images are the intellectual property of the individual who took them, but may not be used publicly without the subject’s written permission.
5. Client Usage Rights
Clients are granted permission to use their final photos for personal and business use, including:
Social media
Websites and online platforms
Marketing and promotional materials
For any additional usage—such as reproduction in media or commercial publications—explicit permission must be granted in writing by the Photographer. Where possible, a photo credit (e.g., Photo by Darius Bashar) is appreciated but not mandatory if the publication omits it.
6. Failure to Perform
If the Photographer is unable to fulfill this agreement due to events beyond their control (e.g. illness, fire, natural disasters), the full payment will be refunded.
In the rare event of technical failure (e.g. lost/damaged files, equipment failure), liability is limited to the total value of the original order. No further compensation will be offered.
7. Image Editing & Retouching
All delivered images will be professionally edited for:
Skin softening
Exposure
Brightness
Contrast
Sharpness and colour adjustments
Final editing decisions (including image selection) are at the Photographer’s discretion. If additional high-end retouching is requested (e.g. detailed work on skin, hair, clothing), it is available at a rate of $75 per image.
8. Complaints & Disputes
All concerns or complaints must be submitted in writing within 14 days of receiving your final images. This Agreement reflects the full understanding between Client and Photographer. Any changes must be made in writing and signed by both parties. This Agreement is governed by the laws of the Province of Ontario, Canada.
